"A judge has turned down a request by a Vermont man who sought to have President Barack Obama’s name tossed from the state’s November election ballots because factors about Obama’s birth make him ineligible to be president.
H. Brooke Paige of Washington, Vt., had sought a court injunction stopping the distribution of ballots. His claim is Obama is not a “natural born citizen” as required by the U.S. Constitution because his father was not an American citizen at the time of Obama’s birth.
“The court has been presented with a radically insufficient basis on which to issue a temporary or even a preliminary injunction,” Judge Robert Bent wrote in a four-page ruling issued late Friday afternoon.
