"In September of last year, Sheriff Joe Arpaio of Maricopa County, AZ, announced that he had called upon a “Cold Case Posse” to investigate the image which Obama had released on April 27, 2011 as his “long-form birth certificate” in the wake of a complaint of possible fraud brought by residents of his community. Numerous analysts had deemed the image a forgery shortly after it was posted on the internet and on the official White House website.
By the end of October, Arpaio had stated that “The results of a formal law-enforcement investigation into whether Barack Obama is eligible to be president of the United States could come as a “shock.”
Since 2008, a growing number of Americans have questioned whether or not Obama qualifies to serve as president by meeting the “natural born Citizen” requirement in Article II, Section 1, clause 5 of the U.S. Constitution. Some questions have focused on the fact that the person he has claimed is his father was never a U.S. citizen; others have questioned his alleged birth on U.S. soil since no hospital has claimed his birth. There have been numerous reports that Obama was born in Kenya or Indonesia.
Beginning with lawsuits filed in 2008, the U.S. Supreme Court has declined to issue a decision on the meaning of the term “natural born Citizen,” and one of the justices has even stated that they are “evading the issue.” Another has recommended against “looking to the U.S. Constitution” as a guide for the new Egyptian government.
However, previously, the U.S. Supreme Court has referred to the term used in Article II in four cases spanning more than a century of American jurisprudence and appeared to indicate that the citizenship of the parents was a determining factor in whether or not a person was considered a “natural born Citizen.”
