The (National) GOP Can Not Legally Help Stop Vote Fraud, No Joke

    Gulag Bound

    PolitiJim
    11/13/2012

    Excerpt:

My good friend Alan Vera of True the Vote told me long ago that we have a two party system: the Corrupt Party and the Stupid Party. To that fact, during the weekly True the Vote webcast, Catherine Engelbrecht related a meeting she had with RNC Chairman Reince Priebus, asking what the GOP would do about voter integrity. The answer?

Nothing. They aren’t legally able to. (I’m not joking.)

As part of a lawsuit settlement with the Democrat Party, the Gutless Old Party agreed to not engage in any voter protection initiatives. Two of the clauses read this way:

    (e) refrain from undertaking any ballot security activities in polling places or election districts where the racial or ethnic composition of such districts is a factor in the decision to conduct, or the actual conduct of, such activities there and where a purpose or significant effect of such activities is to deter qualified voters from voting; and the conduct of such activities disproportionately in or directed toward districts that have a substantial proportion of racial or ethnic populations shall be considered relevant evidence of the existence of such a factor and purpose;

    (f) refrain from having private personnel deputized as law enforcement personnel in connection with ballot security activities.

ACORN Whistleblower Anita Moncrief added that when she spoke at the Republican National Convention, she had to submit her speech to make sure nothing she said could be construed as violating the order not to assist voter integrity.

I now think the characterization “the Stupid Party” may be too kind.

Engelbrecht said to add insult to injury, the judge who signed the agreement has long since retired, but every single year comes back for the sole purpose of renewing the order for another year.

Moncrief pointed out during her comments [in the conference] that in visiting the Democrat advocacy groups in Ohio, they were organized, motivated and purposeful in getting out their vote as was witnessed by the long line of Somali and Ethiopian voters bussed in to polling places. When she visited the Romney campaign offices, she said there was utter confusion, many were just sitting around waxing about how the couldn’t wait to “Free Willy.” (ORCA was the name of the failed computer program the Romney campaign tried to use to “micro-target” volunteers to get out the vote where it was needed.)

It was down all day, and finally late in the day people were sent out with printed registration cards to go find people to vote.

Wasn’t I told by all the non-TEA Party Republicans that Romney was the best chance we had because he ran such great businesses and had the money to compete with Obama? Just asking.

Moncrief said one other thing of interest. When she visited random Ohio polling places, there was almost never a GOP poll watcher and always a Democratic one.

We wondered why the RNC wasn’t screaming bloody murder over the evidence of voting fraud? Of course, the RNC petitioned to get it changed this year but the Obama appointee denied it. Surprise, surprise.

    Now you know.

WHERE HAVE ALL THE REPUBLICAN VOTES GONE?

Your Republican Party Will not Ask

    TPATH

    11/19/2012

    Excerpt:

November 19, 2012 TPATH- There is a strange thing going on in this country and there seems to be no one willing to step up and say “This must stop.” At last count there are over 150 voting districts across this country, where the American people are being asked to either believe or just accept, that not one person in those 150 districts totaling tens of thousands of votes, voted for Mitt Romney.

Once again conservative Americans are being told to “shut up and sit down” and it appears they are doing so. Will you?

Are we to believe that not one idiot Obama voter voted for Romney by mistake? If I remember correctly, just a few short years ago we were told Democratic voters were so incompetent and illiterate that they made thousands of incorrect votes when they tired to vote for Gore. Now in just a few election cycles, not even one boneheaded Democrat made an error and voted for Romney. Really?

No doubt you have heard all the pundits, even those supposedly on the right, declare that sure there may have been some voter fraud, but not enough to change the election.

    What?

How do they know that unless they investigate? If voter fraud does not change elections, why do they do it? Are the just practicing for the day it may change elections? That day people is here and anyone with a half-brain knows it.

Why, one might ask, would the Republican Party, which spent billions of donated dollars in this campaign, lay down like over cooked linguini? The answer, you may be surprised to hear, is they have to.

Not legally and not in the name of the GOP.

And why can't they? Because, and in these times of rage against an inept and spineless Republican party, they do not want what's left of their dwindling party members to know that they agreed, in 1981, not to challenge any voter fraud. That decree, possibly the most stupid, selfish and idiotic thing, among many, that our GOP has done, has given over these last 31 years, carte blanche to the left to steal elections.

This edict, which has the force of Federal law has been renewed, over and over again by a Leftist judge appointed by Carter. This man, District Court Judge Dickinson R. Debevoise, long retired and pushing 88 years of age, returns every cycle to renew the decree.

Read the decree (link given in original article): No.09-4615

The decree states, paraphrasing, that the Republican Party will not legally challenge election fraud in national elections, especially in minority areas.

You think this is a joke?

Well it is not. So you wonder why the leaders of the Republican Party are as quiet as church mice in the face of having the Presidency stolen right out from under them?

The answer is, they cannot afford to let let their party know, especially now with a ground swell of support for a viable third party, just how horribly incompetent they are, have been and will continue to be.

It appears that your Republican Party, back in 1980, may have broken the 1965 Voter's Protection act and in an effort to keep from being fined or imprisoned, they signed away YOUR rights to fair and clean elections, apparently for all time. Maybe just another reason to send the GOP into third party status. If they can't defend our vote, what are they good for?

So....Back to the missing Romney votes. What can be done? TPATH has a suggestion. It will take some money and some effort, but if there are any groups or people who believe the integrity of the election system is the basis of our future and our freedoms and do not want to sit idly by while felonies are committed, our votes deleted and our elections stolen, here is what you can do.

Maybe the GOP can not challenge the voter fraud , but they could support lawyers who are ready , willing and able .
" JUDICIAL WATCH " AND " FREEDOM WATCH " can definitely challenge obummer and voter fraud - successfully .
Support these two great organizations and read their history .

GOP legally barred from fighting vote fraud

30 years later, consent decree violation claims still threaten

        WND

        Bob Unruh
        11/20/2012

        Excerpt:

Voting machines suspiciously defaulting to Barack Obama? Buses loaded with strangers appearing at polling stations? Even ballots turning out 100 percent for one candidate in precinct reports?

In short, suspicions of vote fraud?

That’s too bad, because a race-based consent decree negotiated by Democrats against the Republican National Committee a generation ago still has tied the RNC’s hands, and GOP officials could be cited for contempt – or worse – if they try to make sure American elections are clean.

        Impossible?

        No. Fact.

The case is the Democratic National Committee vs. the Republican National Committee, originally from 1982.

Democrats alleged Republicans were trying intimidate minority voters in New Jersey and brought the legal action. The RNC, inexplicably, decided to agree to a consent decree before a Democrat-appointed judge rather than fight the claims.

The judge, Dickinson Debevoise, appointed by Jimmy Carter, later retired but decided he would continue to control the case. The decision requires the RNC – but not the DNC – to “refrain from undertaking any ballot security activities in polling places or election districts where the racial or ethnic composition of such districts is a factor in the decision to conduct, or the actual conduct of, such activities there and where a purpose or significant effect of such activities is to deter qualified voters from voting; and the conduct of such activities disproportionately in or directed toward districts that have a substantial proportion of racial or ethnic populations shall be considered relevant evidence of the existence of such a factor and purpose.”

The rest of the agreement essentially requires the RNC to follow applicable state and federal election laws.

But the section cited above has been used for decades to warn off Republicans from any challenge to evidence of voter fraud in districts with “racial or ethnic populations.”

The law has remained, even though the RNC recently challenged it at the appellate level only to be turned down by Judges Joseph Greenaway Jr., appointed by Bill Clinton; Dolores Sloviter, appointed by Carter; and Walter Stapleton, appointed by Ronald Reagan, in the 3rd U.S. Circuit Court of Appeals.

It now is pending before the U.S. Supreme Court.

But two election veterans both told WND it still is hurting the fight against voter fraud in the United States.

Attorney James Bopp of the James Madison Center said the threat that the RNC has faced is that someone will allege a violation of the decree, and party officials will be standing in a courtroom on Election Day.

Bopp’s organization was founded to protect the First Amendment right of all citizens of free expression and “to support litigation and public education activities in order to defend the rights of political expression and association by citizens and citizen groups as guaranteed by the First Amendment of the United States Constitution.”

Bopp himself has taken part in more than 60 election-related cases, including recounts, redistricting and constitutional law challenges to state and federal election laws.

He said the agreement even today, amid reports of fraud across the country, prevents the RNC from doing any anti-voter fraud activity on Election Day.

“It is way too restrictive,” he said. “It prevents the RNC from working with state parties in conducting voter integrity activities. It has been used by the DNC to harass the leadership of the RNC with false allegations of violations of the consent decree.”

He said the reason why the RNC originally agreed to the decree, rather than fight the allegations, was unclear. But he said he investigated the issue.

“It was very troubling that the RNC’s effort to ensure the integrity of the vote would be undermined,” he told WND.

While there have been periods in U.S. history in which there have been concerns about minority voting, the restrictions today, he said, are “completely unjustified.”

“It’s become absurd,” he said, noting that the GOP has had a black chairman.

Voters, he said, would be best served to have both political parties watching for vote fraud.
