    The nauseating hypocrisy of this guy is incredible. When caught red-handed by Breitbart, who tracked down a tip that Mark Kelly, former Rep. Gifford's husband purchased an "assault weapon," here's what the gun control advocate put on his Facebook page:

    I just had a background check a few days ago when I went to my local gun store to buy a .45. As I was leaving, I noticed a used AR-15. Bought that too. Even to buy an assault weapon, the background check only takes a matter of minutes. I don't have possession of it yet but I'll be turning it over to the Tucson PD when I do.


    Did I mention that witnesses say he also purchased several "high capacity" magazines as well?

    We are to believe he bought the weapon just to turn it over to the police? Or is he turning it over to the police because he's been caught in a very compromising position that makes him out to be a dishonest, gun grabbing lout?

    Testifying to the Senate Judiciary Committee Jan. 30, Kelly had urged senators to restrict sales firearms based on their lethality--a common refrain with other witnesses that day, who argued that semi-automatic weapons, which chamber subsequent rounds as bullets are fired, and other guns with military-style features level the playing field against law enforcement.

    Kelly and Giffords founded their own advocacy group to restrict gun rights, Americans for Responsible Solutions, in January. On its website, ARS wrote: "High capacity magazines are a deadly factor in gun violence." A 30-round magazine is considered a high-capacity magazine.

    The ARS website says: "Congress should act to limit the sale of high capacity magazines, which are not needed for hunting or self-defense, but have proven very lethal."

    Similarly, the ARS website says: "Congress should act to limit the sale of assault weapons.

    In February, Kelly told Fox News Sunday's Chris Wallace that lawmakers need to address "assault weapons." He said the purpose of an "assault weapon" is "to kill a lot of people very quickly," and he lamented that such products were "too readily available."

    Kelly has not commented on whether he will also return the .45 caliber semi-automatic pistol he purchased.

    Gun Shop Owner Says Mark Kelly Has Not Completed Background Check For AR-15

    Why did Mark Kelly pick a rifle for which he has yet to do a background check?

    Kelly, a gun regulation advocate and husband of former Rep. Gabrielle Giffords, has explained that he bought an AR-15 rifle last week because he wanted to show how "easy" it was to buy an "assault weapon."

    Yet if that were really his purpose, why did he purchase a traded-in rifle for which he must wait 20 days--and for which he must still complete a background check? Why not purchase a new rifle he could have claimed immediately?

    Kelly may have completed the background check process for the pistol he bought, but not for the AR-15. On March 12, after Breitbart News contacted Diamondback Police Supply, the store where Kelly bought the weapons, the store's owner Douglas MacKinlay provided the following statement to the media:

    On March 5, 2013 Mr. Mark Kelly purchased a Sig Sauer 45 caliber pistol and a Sig Sauer M400 5.56 AR style rifle from my company, Diamondback Police Supply Co. in Tucson, AZ. The rifle, having been purchased in trade from another customer, cannot be released to Mr. Kelly or any other customer for a minimum of 20 days in accordance with local ordinances. Mr. Kelly did not ask for any modifications to the rifle, nor are we making any. Once the hold period is up, Mr. Kelly must then show proper identification, complete the Federal Firearms Transfer Record (Form 4473) and successfully complete the NICS background check prior to his taking physical possession of the firearm. [emphasis added]

    The "local ordinances" that apply to the Sig Sauer M400 5.56mm AR-style rifle required that the AR-15 be placed on hold for 20 days because it was second-hand. If Kelly's goal was to show how easy the background check system really is, why didn't he buy a new "assault rifle" so he could take possession of it immediately, thereby allowing him to finish the background check on day he originally walked into the store--March 5?

    When CNN's Wolf Blitzer asked Kelly on Monday what it was like going into a gun store and "buying an AR-15." Kelly said that for such a "deadly" weapon, "especially with the high capacity magazines, it's a pretty easy thing to do, even with the background check."

    He went on to say: "public access to these [weapons] is too easy, as I demonstrated the other day."

    Yet Kelly has not completed the process of taking possession of the AR-15.

    Kelly has openly stated that his plan from the beginning was to buy such a firearm and hand it over to the police (even though, as Breitbart News reported, under pending legislation the police would likely have to sell the AR-15 rather than destroying it, returning it to the streets).

    In that case, wouldn't any AR-style rifle do?

      Mark Kelly's campaign against "assault weapons" such as the AR-15 rifle has sparked a local backlash. On March 13, a Tucson, Arizona radio host published a photograph of former Congresswoman Gabby Giffords holding an AR-15 rifle at a gun range. Giffords has since confirmed that the photograph is authentic.

      James T. Harris, blogging at the website of "101.4 FM The Truth," wrote:

      What is wrong with this picture? Absolutely nothing, and prior to the aggressive progressive opportunistic fear mongering in the wake of Sandy Hook, this picture would have raised no eyebrows and garnered little public attention.

      However, in response to the exploitative political scheming of Mark Kelly, persons connected to Congresswoman Giffords released this photo in response to what they perceived to be her husband’s hypocrisy.


      Subsequently, Breitbart News confirmed the authenticity of the image through law enforcement sources in Arizona, and obtained a copy of the photograph from a source who requested anonymity.

      The latter source was present when the photograph was taken, and said that Giffords had requested it for campaign purposes during October 2010.

      According to the source, the image sent to Breitbart News was cropped to protect the identity of the person on the right-hand side of the original photograph (to Giffords's left).

      The source, who is a member of the law enforcement community, told Breitbart News:

      "We were told she wanted to toughen her image. She asked to come out and she wanted to shoot a rifle. She had one of our guys out there to show her how to shoot an AR-15."

        Diamondback Police Supply owner Douglas MacKinlay has halted Mark Kelly's attempted purchase of an AR-15 over concerns that Kelly was not in fact buying the gun for himself, and therefore could not have passed question 11a of the NICS background check form 4473.

        You'll recall Kelly's AR-15 had been on hold for 20 days because it was a trade-in firearm, and during those 20 days Kelly has not been shy about the fact that his plan was to buy the gun and give it to someone else all along.

        Gun store owner Doug MacKinlay has now released this statement:

        While I support and respect Mark Kelly's 2nd Amendment rights to purchase, possess, and use firearms in a safe and responsible way, his recent statements to the media make it clear that his intent in purchasing the Sig Sauer 5.56mm rifle was for reasons other than his own personal use.

          Breitbart News can now report that although Gabby Giffords' husband Mark Kelly successfully purchased a .45 caliber semi-automatic handgun from Diamondback Police Supply on March 5, the gun store had denied his attempts to buy a handgun approximately two weeks before that.

          According to sources, when Kelly first came into Diamondback Police Supply in February he tried to use a Texas ID to buy a handgun and was denied. Then, thirteen days later--on March 5-- Kelly walked back into the gun store with an Arizona ID that he used to purchase a handgun. He posted a video of that purchase made with a hidden "pocket camera" recording the transaction to prove that "background checks are easy."

          With the proper Arizona ID, Kelly successfully purchased a Sig Sauer 1911-style .45 caliber pistol. He also tried to buy an AR-15 rifle, but gun store owner Douglas MacKinlay ultimately halted Kelly's AR-15 purchase due to concerns over whether Kelly could pass question 11a on background check form 4473, since Kelly had publicly claimed he had bought the gun to deliver it to someone else (in this case, the local police department).

          On March 31 Breitbart News reported that when Kelly released his hidden video to show that "background checks are easy," the failed purchase of the AR-15 appeared to have been edited out. Kelly's apparent failed attempt to buy a handgun at the Arizona gun store in February didn't make the final cut, either.
