The Post & Email published the following this morning before the live broadcast:

After a discovery made by a private investigator that indictments for a fugitive sought for 24 years by the FBI were inexplicably dismissed by a magistrate judge in Washington, DC, Sibley submitted a request under the Freedom of Information Act to discover the reason.

His request to file a motion in the case was denied by Magistrate Judge Deborah A. Robinson. Sibley claimed that Robinson had “no authority” to dismiss the indictment because the law states that only a full judge can do so.

Sibley appealed to the U.S. Supreme Court, which refused to review his Petition for Certiorari.

Elizabeth Ann Duke is still ostensibly “Wanted” by the FBI despite the dismissal of the indictments. She had co-founded an organization, the May 19 Communist Organization, which was closely aligned with domestic terrorist William Ayers.

Sibley believes that “criminal behavior” is behind the dismissal of the indictments and sealing of the record by Robinson. - The Post & Email. - Montgomery Sibley's blog ....
